Senator Tim Scott, chairman of the Senate Banking Committee, has signaled that the Crypto Clarity Act is approaching a Senate vote. This is a statement about procedure, not physics. And yet markets are already treating an imminent vote as a downward revision of regulatory risk. In its broadest form, it would divide the asset class into two categories — commodity and security — and assign each to its respective regulator. It would also, potentially, define what decentralized means in a legal sense. That definition, more than any other clause, would reach into protocol architecture and alter the cost-benefit calculus of governance teams.

The current baseline is regulation by enforcement. Projects do not know, until an SEC complaint lands, whether their token is a security. That uncertainty imposes a hidden tax: US-facing issuers restrict access, exchanges delist or geo-block, and legal opinions consume what would otherwise be engineering budgets. The ledger does not record that tax directly. But it appears as wider spreads, lower liquidity, and a supply curve that behaves as if a portion of circulation has been quarantined.

From a practitioner's standpoint, the Act is not a technology upgrade. It is an environmental variable. I have audited smart contracts where the logic was efficient and the assumptions were fragile. The same applies to proposed legislation. The assumptions embedded in the Act — that two regulators can cleanly divide atomic tokens, that decentralization can be quantified, that compliance costs can be socialized — will determine its real effect.

The central lesson: when you define a reward function, agents optimize for it. The same is true of founders.
